Response to Deletion Request -- File: Marshall_Strabala_April_2010_in_Shanghai.jpg[edit]

I respectfully wish to strongly opposed the deletion of this image which appears in Wikimedia Commons and is found both on the Chinese Wikipedia page for Marshall Strabala as well as his English Wikipedia page (http://en.wikipedia.org/wiki/Marshall_Strabala)

I obtained this image directly from Marshall Strabala and his wife Joan Mills, and they asked me to place the image on these pages. I am a close friend of theirs. The image, while it shows Marshall Strabala in Shanghai, is a US-owned image as Mr. Strabala is an American citizen. He just happens to be currently working in China now as a temporary resident. So, while I may have used the wrong license (??), the license that I wish to use is the Public Domain license for US material. This is, I repeat, not a Chinese-owned or controlled item, it just happens to show the subject in China. You could compare this to a picture of President Obama taken on a visit to China. Such an image would not be a Chinese owned or controlled (unless the photographer happens to be Chinese and owns the image). So, I ask that the licensed be updated if needed to fit this use, and the image itself should remain on Wikimedia Commons, Wikipedia English and Wikipedia Chinese. FYI, I also personally placed most of the many architectural images on Marshall Strabala's Wikipedia page, which I also have been provided directly by Mr. Strabala and his wife. I have changed the PD license to {{Cc-by-2.0}} because the image is identical to the CC-licensed image on Flickr.
If you wish to have a public domain license applied to this and other images you can do this: ask the copyright holder to send an email confirming the free license to permissions-commons@wikimedia.org, see Commons:OTRS for details. Alternatively you can email the copyright holder (this might be Marshall Strabala at www.gensler.com) and send the reply you receive to permissions-commons@wikimedia.org. In either case do not forget to include a link to the image in question, otherwise the OTRS volunteer will not know what the email is about. The process is very similar to the permissions procedure of the English wikipedia. As to any English Wikipedia images from Marshall Strabala, you could list all the image page links together in one single email and send that to the copyright holder requesting a free license (either Creative Commons Attribution, or plain Public Domain).   • The licensing assumed from flickr http://www.flickr.com/photos/architectural-design/4581482175/ is questionable. I fully agree with Ilmari.
  • The license selected with the upload ({{PD-US}}) is obviously wrong. please use the preview function with your upload! If the license tag says something like "This media file is in the public domain [...] because its first publication occurred prior to January 1, 1923" you MUST stop your upload an recosnsider your selecteion to fix this obviously wrong claim.
  • The uplaoder said here on this page, that he wants to use the image under public domain. However, he is neither the creator nor the copyright owner, so his statement is irelevant for the licensing status. The copyright holder must give written permission, not someone else.
